MenuClub Privacy Statement
MenuClub, Inc. (“MenuClub”) takes the privacy and security of our clients and their customers very seriously. MenuClub provides this Internet Privacy Statement because our clients and their customers have a right to know what information we collect, how it is used, and how it is protected.
Information Collection and Use
Registration for MenuClub Client Customers
In order receive emails sent by MenuClub on behalf of its clients; you must first complete a signup form (a) in a participating store, (b) at an event, (c) by dropping your business card in a MenuClub basket or other collection device that states you are choosing to join the client’s email list, or (d) by registering online through its web site. During registration, you are required to give contact information (such as first and last name, month and day of birth, and email address). The client provides this registration information to us. MenuClub collects personally identifiable information from our users during the initial signup process as well as during surveys or preference requests. We use this information to contact you with offers, newsletters and special promotions which you have expressed interest in receiving.
You may also be given the opportunity to provide your cell phone number during the sign-up process or through a separate email from a MenuClub client. By providing your cell phone number, you are agreeing to receive text (SMS) messages on your cell phone. You have the option to provide demographic information (such as gender and zip code) to us; we encourage you to submit this information so we can provide you a more personalized experience. If you elect not to provide such demographic information, you may still participate in the client’s program offerings.
You may also be given the opportunity to provide a rating for a MenuClub client. By providing a rating comment and leaving the "Comment Public" box checked you are agreeing to the use of your first and last name and associated comment described in Uses of Customer Information below.
Communications may include offers, newsletters, updates, special promotions, surveys and unsubscribe confirmations.
In compliance with the Children’s Online Privacy Protection Act, MenuClub requires all children under age thirteen (13) to obtain parental consent to join any of our lists. All terms of our privacy policy apply to children under 13.
Uses of Customer Information
Your email address is used only to send email that was requested. Your email address and personal information may be added to FansRave®, a deal/coupon distribution and sharing site. You will only receive email communications for clients where you have opted-in to their email communications via the registration processes outlined above or if you choose to follow other businesses on FansRave®. You will be given the option to opt-out of emails from FansRave® communications.
MenuClub follows an opt-in permission-based email and text message (SMS) enrollment policy. MenuClub will not send unsolicited, bulk or commercial offers or advertisements. MenuClub will NOT rent, sell, trade or loan our clients’ lists to anyone. All emails contain links on how to unsubscribe from the client list. All SMS messages contain information on how to unsubscribe from the client list. You may leave our client’s lists at any time for any reason. If you have any questions or feel that you received unsolicited email or an unsolicited SMS message please contact us at customercare@menuclub.com.
Your first and last name and associated rating comment is intentionally open to the public and is not in any way private. You should think carefully before publicly disclosing any personally identifiable information. What you have written may be seen and/or collected by third parties and may be used by others in ways we are unable to control or predict.
MenuClub and MenuClub clients will use personally identifiable information to contact you when responding to email support requests, customer rating comments, and other direct requests for information. To protect your privacy and security, we will take reasonable steps to verify your identity before granting access or making corrections.
Social Media Sites
We also may collect personally identifiable information when you participate in activities that we sponsor on social media sites such as Facebook, Twitter, YouTube, and Instagram. Each of these sites has its own privacy policy and terms and conditions, and you are responsible for reviewing and complying with the policies and rules for each social media site in which you participate.
Surveys or Contests
From time to time we may provide you the opportunity to participate in web-based contests or surveys. If you participate, we will request certain personally identifiable information from you. Participation in these surveys or contests is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information (such as name address and phone number(s)), demographic information (such as zip code) and personal preference information (such as your opinions). This information is used by our clients to better understand their customers.
MenuClub may use a third-party service provider to conduct these surveys or contests; that company is prohibited from using your personally identifiable information for any other purpose. We will not share the personally identifiable information you provide through a contest or survey with any third party except with the client unless we give you prior notice and you elect to permit the provision of that information to the third party.
Forward to a Friend
If you choose to use our referral service to tell a friend about an email club to which you subscribe, we will ask you for your friend’s name and email address. This process will automatically send your friend a one-time email inviting him or her to join the client email list. MenuClub stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program, after which the names collected are removed from the database.
Information Sharing and Disclosure
That’s Biz only shares your data with the client from which you have requested to receive offers. We provide the client with your personally identifiable data and we share reports about your statistics and information about your preferences. While the client retains ownership of your data, it has agreed that MenuClub retains management during the term of their Agreement and that it will not rent, sell or otherwise provide to third parties.
If MenuClub merges or is combined with any other organization, or if MenuClub transfers all or substantially all of its assets or operations to another organization, it may disclose information it collects from you to the other organization so that the other organization can continue to provide services to you. The other organization will be bound by this policy.
Service Providers
We use third parties to provide data entry for our client list member enrollment. When you sign up for an email club, we will share your enrollment information with our data entry company so that the third party can provide the service. Such third parties are prohibited from using your personally identifiable information for any other purpose.
Upon request from a MenuClub client, MenuClub may use a third party vendor to fulfill promotions on behalf of MenuClub and the client. Any third party vendor to MenuClub is contractually prohibited from using your information for any other purpose.
Legal Disclaimer
We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to (a) protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our Company; (b) protect and defend MenuClub’s rights or property or the users our services, and (c) act under exigent circumstances to protect the personal safety of users of our services or the public.
Opt-out/Unsubscribe
If you no longer wish to receive our communications, you may opt-out of receiving them by following the instructions included in each communication or by emailing us at customercare@MenuClub.com, please include your email address and/or cell phone number in the message along with the client you wish to unsubscribe from as well as write the word, “unsubscribe” in the subject line. Alternatively, you may contact us at 888-636-8252 or mail the information to MenuClub Inc., Attention: Privacy Dept., 2995 McMillan Ave. Suite 196, San Luis Obispo, CA 93401.
Please note, changes may not be effective immediately. In each event, you must clearly indicate the information that you wish to have changed or clearly indicate that you wish to have your personally identifiable information removed from our database. We will endeavor to comply with your request as soon as reasonably possible. Note that despite any request for removal of or change to personally identifiable information, we may need to retain certain information for record keeping purposes and there may also be residual information that will remain within our databases and other records, which will not be removed or changed. Finally, we are not responsible for informing third parties (including without limitation our third party service providers or strategic partners) with whom we have already shared your personally identifiable information of any changes requested pursuant to this section, or for removing information from or causing information to be removed from the databases or records of such entities.
Web Logs
Like most standard website servers, we log IP addresses (a unique number assigned to every computer on the Internet) in order to improve security, analyze trends and administer the Sites. We may track your movement within the Sites, the pages from which you were referred, access times and browser types. This information may include the browser you are using, the internet address from which you linked to our Sites, the operating system of your computer, the unique IP address of the computer you used to access our Sites, and usage and browsing habits. We use this information in the aggregate to gauge the effectiveness of our Sites, track information for statistical purposes, help diagnose and troubleshoot server malfunctions, analyze trends, track user movement in the aggregate, and gather broad demographic information. We may also use individual information we collect through web logs to send you targeted offers and other communications.
Web Beacons - Pixels
Our web pages and emails contain "web beacons." Web beacons allow us to count users that have visited a web page or opened an email that contains a web beacon and collect other types of aggregate information. Using this information, we are able to measure the effectiveness of our advertising and how visitors use our Sites. This allows us to learn what pages are most attractive to our visitors, which parts of our Sites are the most interesting and what kind of offers our registered users like to see. Some of the web beacons that are in place on our Sites are used only by us, and other web beacons are from our service providers who use this data to assist us in analyzing how our Sites are used.
Clear Gifs
We use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. If you would like to opt-out of these emails, please see “Opt-out/Unsubscribe”.
California Business & Professions Code 22575(b) provides that California residents are entitled to know how Bojangles’ responds to “Do Not Track” browser settings. We do not currently respond to these signals because there is no uniform technological standard for doing so. We may adopt a standard in the future.
Cookies
MenuClub places a “cookie” on the browser of a MenuClub.com user’s computer to store and sometimes track information about you. Cookies are information files that your web browser places on the hard drive of your computer when you visit a website. Cookies were designed to help a web site recognize the prior visits to a site made by a user’s browser. Cookies cannot damage user files, pass on computer viruses, capture e-mail addresses or read information from a user’s hard drive.
A cookie can be used to measure certain traffic patterns on MenuClub’s website. For example, when you sign in to MenuClub’s website using your user name and password, MenuClub stores your unique information, and the time you signed in, in a cookie on your hard disk. This cookie allows you to move from page to page at the site without having to sign in again on each page. MenuClub may also use cookies to track your progress while using MenuClub Services. At MenuClub, we do not store any personal information into cookies nor do we link or combine information collected through cookies to any personal information that is submitted online when using our Services.
You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to sign in or use some features of MenuClub’s website and services that depend on cookies.
Links to Other Sites
Emails that we send on a client’s behalf may contain links to other sites that are not owned or controlled by MenuClub. Please be aware that MenuClub is not responsible for the privacy practices of such other sites and do not exercise authority over such web sites. MenuClub therefore assumes no responsibility for the privacy and data collection policies and procedures of such linked web sites, nor for the content or reliability of such web sites. If you choose to access a third party web site, you do so at your own risk.
Access to Personally Identifiable Information
If your personally identifiable information changes, is incorrect, or if you no longer desire our service, you may correct, update, delete or deactivate it by making the change on our member information page or by emailing our Customer Support at customercare@menuclub.com or by contacting us by telephone or postal mail at the contact information listed above. We will be happy to review, update or remove information as appropriate. We may still retain your information in our files however, to resolve disputes, enforce our Terms of Use, and due to technical and legal requirements and constraints related to the security, integrity and operation of our Sites.
Data Security
MenuClub has put in place certain technological and procedural security functions in order to protect the personal information it collects, uses or transfers from loss, misuse, alteration or destruction. MenuClub uses firewalls to help prevent outside parties from accessing our database server through the Internet, and physical access to the database server is restricted to authorized individuals.
When transferring personally identifiable information to and from third parties MenuClub uses SSL & SFTP (Secure FTP) (which includes MD5 and SHA-1 encryption), as required for Email Sender and Provider Coalition (ESPC) membership. However, no data transmission over the Internet can be guaranteed as 100% secure. As a result, while we strive to protect your personal information during transmission, we cannot ensure or warrant the security of any information you transmit to us or receive from us. We urge you to take steps to keep your personal information safe (including your account password), log out of your account after use, and close your web browser.
A Note to International Users. By consenting to this Privacy Policy, you confirm that your command and knowledge of English is sufficient to understand the terms and conditions set forth herein. You agree that by using the Sites, your personal data will be transferred to our servers located in the United States in connection with the purposes stated in this Privacy Policy. You understand that the laws with respect to the protection of personal data in the United States may not be as stringent as those in your home jurisdiction and the Sites may not comply with foreign law, so if you do not agree with this, please do not use the Sites.
California Privacy Rights. If you are a California resident, you may request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please write to us at the address below in "Contact Us".
Children's Privacy. The Sites are not directed or intended for children under 13 years of age. We do not knowingly collect personal information from individuals under 13 years of age. If you are under 13 years of age, you should not register or provide personal information on the Sites. If we later obtain actual knowledge that a user is under 13 years of age, we will take steps to remove that user's personal information from our systems. If you are the parent or guardian of a child whom you believe has disclosed personal information to us, please contact us at customercare@menuclub.com so that we may delete and remove such child's information from our systems.
Changes in this Privacy Statement
If we make any material changes to our Privacy Policy or how we handle your personal information, you will know because the Effective Date of the Privacy Policy will change. If we are going to use any personal information in a manner that is materially different from that stated in our Privacy Policy at the time we collected such information, we will give you a reasonable opportunity to consent to the change. If you do not consent, your personal information will be used as agreed to under the terms of the privacy policy in effect at the time we obtained that information. By using our Sites or our services after the Effective Date, you are deemed to consent to our then-current privacy policy. We will use information previously obtained in accordance with the privacy policy in effect when the information was obtained from you.
Disputes. If you choose to visit the Sites your visit and any dispute over privacy is subject to this Privacy Policy and our Terms of Use including limitations on damages, arbitration of disputes, and application of the laws of the State of California.
This Privacy Policy is effective as of January 1, 2020. We reserve the right to modify this privacy statement at any time, so please review it frequently. If we make material changes to this policy, we will publicize such changes by means of a notice on our home page by providing thirty (30) days notice to you by displaying a prominent notice, in all caps, above the text of the Privacy Statement.
